A fence erected as a noise control or attenuation barrier shall be maintained by the owner of the land on which the fence is erected and shall be of the same construction, provided the material is available. In the event the material is no longer available an equivalent material will be utilized. If the barrier abuts land owned by or under the control of the Town, the Town shall not be required to maintain the barrier or incur any costs with respect to the maintenance of the barrier.
