- 4.9 Where a Fence is used as a Guard, it shall be installed and maintained in compliance with the provisions of the Building Code Act and the associated regulations. Further, if a Guard forms part of a Swimming Pool Enclosure, it shall also comply with the requirements of Section 5 of this by-law.
