No person shall carry on the business, trade or occupation of a tree cutting service without a licence. General Operating Conditions Every tree cutting service shall:

• Prior to injuring or destroying any tree, every tree cutting service shall ensure:
• (a) that a permit has been obtained to injure or destroy trees, if required by by-law; or
• (b) if no permit is required by by-law, that the injury or destruction of trees is performed in accordance with any applicable restrictions or conditions on the injury or destruction of trees such as an approved tree protection plan imposed as a condition of development approval. Penalties
