Notwithstanding subsection (1), a driver of a vehicle shall not cause the vehicle to overtake and pass another vehicle on the right:
- (a) when the movement cannot be made safely; or
- (b) by driving the vehicle off the portion of the roadway intended for vehicular traffic. Obedience to Traffic Signals
