Subsection C(3) applies to pool enclosures for which a pool enclosure permit was issued more than 30 calendar days after the enactment of that subsection on 447-8 June 9, 2021 November 20, 2007, and to any existing fence if a substantial portion of it is demolished or removed, or if it is in such a state of disrepair that it is not practical to repair it.
