In any prosecution for an offence under this Part evidence by a person of audible engine noise or visual observation of exhaust coming from a motor vehicle shall be considered prima facie evidence of engine operation. PART V.2 – ODOURS AND EMISSIONS EXCESSIVE 38.6 (1) A person shall not engage in any activity that creates odour, ODOURS AND emission, smoke, vapour, dust or other airborne matter that is EMISSIONS reasonably likely to disturb another individual.
