The General Manager, Engineering and Public Works may approve an application, made under subsection (2) where the applicant demonstrates that the Municipal Solid Waste Collection System cannot provide service adequate to deal with the type or volume of Solid Waste generated by the applicant and the applicant has exhibited a proven effort and due diligence in their efforts to participate in diverting waste through the available services provided.
