Where the ambient sound level at a point of reception (expressed in terms of Leq for a ten-minute period) exceeds the maximum sound level permitted under Subsection B(1), that has a sound level (expressed in terms of Leq for a ten- minute period) equal to or exceeding the ambient sound level.
