Every person who constructs, uses or permit to be maintained a fence shall keep such fence :
- a) in good repair;
- b) in a safe and structurally sound condition;
- c) free from accident hazards, and
- d) protected by paint, preservative or other weather resistant material, except for a hedge or wooden fences made of cedar, redwood or treated wood.
