Refusal of Tree Permit and Reasons The Director may refuse to issue a Tree Permit where:

• The Injury or Destruction of a Tree(s) can be avoided, or ought to be avoided, as confirmed by a Qualified Person; The Injury or Destruction of a Tree(s) within an Environmental Protection Area, Open Space and/or Significant Woodland would have a Negative Impact on identified Natural Features and Areas and/or their Ecological Functions. The Tree Permit Application is on an Active Planning Application Property and a decision has not yet been rendered, or the Director has determined that it is premature to Injure or Destroy Trees based on the anticipated timing of additional approval processes and/or permits that are required before the development can proceed; The Injury of Destruction of a Tree(s) will negatively impact erosion or flood controls; and The Injury or Destruction of a Tree(s) will undermine the objectives of this Bylaw as determined by the Director.
